There's a new rule in AdSense land: You are not allowed to place ads under a misleading post title. The question is, when is a blog post title considered misleading? And what can Adsense publishers do about it?
Here are some tactics you can do to protect your ad earnings...
If you want to continue showing ads right under your post title, you will need to be conscious of how you word your titles. For example, will you something that looks like "Dallas Business Opportunities" or... Wait, can you think of a title about DBO that will not look misleading?
When we say "misleading" we mean a phrase that implies the links in the ad that appear below the title are links endorsed by the blogger.
So in our example, if your title is "Dallas Biz Ops" and then links appear immediately below it, then yes, that can be construed as "misleading."
Which brings us back to the question: How can you reword "DBO" differently, so that it is no longer considered misleading? Well, if you don't want to scratch your head forever, you can always try a different approach.
Don't place your ads right below your blog post title.
If you wish, you can (as Marghil has done) place your ad outside your blog post. For example, instead of having:
Blog Post Title
Ad
Blog body
You can have:
Ad (with a div float left/right command)
Blog Post Title
Blog body
We'll need to test, naturally, how this will affect your ad earnings. Will it go up, down, or stay the same?
I've seen numerous blogs that have the ad to the left or right of the blog post title, and those blogs still earn AdSense dollars. In other words, it won't hurt that much for you to test it on your site.
You can also experiment with the AdSense Plugin (for you WordPress bloggers) to randomly place ads anywhere within the body of your posts. By the way, I found out about this new AdSense rule thanks to Macuha.com's Adsense Update: Ad Below Misleading Post Title Is Not Allowed.
(For the Host4Profit 1028 Promo customers, don't worry. Your titles have been reviewed and so far, none of them are considered "misleading.")
Anyway, expect more changes in the future. Just keep in mind that Google is trying to eliminate accidental or unwitting ad clicks. If you keep the advertisers interests and your visitors' interests in mind, you'll have a sustainable and profitable ad revenue strategy.

I prefer to put the Adsense rectangle inside the body of the post (just like your opt in form) and then the Adsense skyscraper in the sidebar. Having ads right under the title can be quite annoying for readers don't you think?
Adsense rectangles placed inside the body of the post can be right-aligned, or left-aligned (in which case it will appear right under the title). Yes, some readers will get annoyed by ads that are left-aligned, because it interferes with their reading experience.
How about link ad? Can I place it under the post title?
[From Manuel] If the post title is considered "misleading" by Google, any AdSense unit should not be placed under the post title.
I make use of the adsense script called adsense-injection. That said every post I made where I inserted a picture I used this script to insert a small "keyword" telling the script when to start inserting the adsense code into the body of the post.
That way I knew I would not in any way offend Google by placing my code near a picture.
I have wondered about the fact that sometimes when I was not using a graphic in a post that the adsense ad would sometimes be placed right after the topic whether it would be considered a bad practice. Thanks for pointing it out.
From now on I will post as always but always use the instruction for the adsense-injection script to only show the ads any place in the post after my first paragraph of text.
